Rahul Gandhi moves Gujarat HC to win back MP seat

NEW DELHI: Congress leader Rahul Gandhi approached Gujarat HC asking to suspend the earlier Surat court verdict finding him guilty for the casteist diatribe. Earlier, Surat chief judicial magistrate court and Surat additional sessions court restrained from providing relief to Gandhi which forced the latter to approach Gujarat HC. The appeal with Rahul Gandhi's signature was submitted to the HC. If the verdict comes in favor, Rahul will be able to regain back his post as a member of parliament. If the court withstands its earlier decision, Rahul Gandhi is left with little option but to approach the supreme court of India.

The law requires that if one is convicted in any offence for two years, his or her seat will be vacant. One can stay on as an MP only if the conviction is suspended.

In his appeal to the Surat court earlier this month, Mr. Gandhi had said the trial court had treated him harshly, overwhelmingly influenced by his status as an MP.

In his appeal to Gujarat HC, Rahul advocates his usage of the 'Modi' remark as one intended solely at PM Narendra Modi. Such that, the Surat HC verdict falls out of place. He later remarked about implementing his duty as an opposition leader to criticize the ones in power.
