KANNUR: The Thalassery Principal Sessions Court said that the speech of PP Divya, which led to the death of ADM Naveen Babu, was planned. The speech was filmed and circulated using a local channel with meticulous planning. The intention was to insult Naveen Babu. The Thalassery Principal Sessions Court in its verdict rejecting Divya's anticipatory bail plea said that Divya's act was with knowledge of the result.
The court accepted the argument of Naveen Babu's family and the public prosecutor that Divya had come to the function without being invited. Divya claimed that she had not done anything to charge her with abetment to suicide. The court delivered a detailed 38-page verdict.
Prima facie proved guilty
The verdict said that the charge of abetment to suicide would remain and prima facie it was established that Divya had committed the crime.
Naveen Babu was insulted in front of his colleagues. He committed suicide unable to bear the burden of humiliation
Divya is a person with political influence and may influence witnesses. If anticipatory bail is granted, it will be a wrong message.
Divya's act is not suitable for a public servant.
The defence could not produce the complaint of petrol pump applicant TV Prasanth. The complaint produced in the court was the one raised by retired teacher Gangadharan in connection with the land-related issue. There are no allegations of bribery in this complaint.
The speech was partly concealed in the CD produced by the defendant. Divya had said that she noticed the farewell ceremony while on the way to somewhere else. The defence produced the speech omitting this part.
Arguments such as that Divya is a good public servant and has a family cannot be considered as a reason for granting anticipatory bail.
Divya should have approached the police or vigilance if she came to know about the scam. Instead, she tried to make fun of the top official in public.
