ABU DHABI: There is one thing that those working or looking for work in the UAE should be aware of. You can lose your job without breaking the law or committing a crime. UAE law specifies provisions for dismissing those who perform poorly on the job.
Article 16(8) of Federal Law No. 33 of 2021 stipulates that a worker must work diligently and develop work skills in the UAE. The employer has the power to take disciplinary action against the employee if he does not perform well as per the contract. If such things are noticed, the worker can be sent a notice, warned or dismissed from the job.
Article 39 (1) (a), (b) & (g) of the Labour Act states that in case of poor performance, the matter may be brought to the attention of the employee, notice given in writing and dismissal with pay. Additionally, an employee may be terminated without notice based on poor performance after the employee has been given two written warnings and an investigation into the complaint has been completed.
If the employee is found to have violated the terms of the contract, the complaint should be investigated and action taken within 60 days. Meanwhile, if the dismissal is done without complying with the above conditions, the employee can approach the Ministry of Human Resources, stating that the action is arbitrary.
