KOCHI: The Ernakulam District Consumer Disputes Redressal Commission has said that the TV manufacturers who failed to repair the TV even during the warranty period have resorted to service deficiency and unethical business practices. Rs 5,000 compensation and Rs 3,000 court costs were also ordered to be paid to the opposite party customer within 45 days. The order was filed against Samsung India Limited by Sourav Kumar N A, a resident of Kothamangalam, Ernakulam.
The complainant bought the LED TV by paying Rs.15,200. The opposite party was approached after the TV became non-functional within three years but the company refused to repair the TV even though it was defective within the warranty period. Subsequently, the complainant approached the commission demanding the price of the TV, compensation and court costs.
The bench, headed by DB Binu and comprising V Ramachandran and TN Srividya, observed that the action of the opposite party in not providing the TV within the warranty period of three years, even though it was inoperable, was a deficiency in service and an unethical business practice. The penalty amount must be paid to the complainant within 45 days.
