ABU DHABI: Labor laws have been tightened in the UAE, the Gulf country that most expatriates, including those from Kerala, rely on. Ministry of Human Resources & Emiratisation has issued employment guidelines for private companies. The instructions mainly say that the appointment should be only as per the terms and conditions. It is also suggested that there should be no appointments in violation of the rules.
One of the suggestions is that there should not be a situation where an offer letter is not given while hiring someone. The nature of the job, hours of duty, salary and other benefits should be clearly mentioned in the offer letter. Although there is permission to increase the benefits, it is strictly instructed that the benefits should not be less than what is mentioned in the offer letter. Provisions contrary to labour law should not be included in the employment contract.
The authenticity can be verified through the serial number on the job offer letters approved by the Ministry. Workers' files and records must be properly maintained. Companies are obliged to submit them to the Ministry if requested. No employee's official documents such as passport, identity card, bank card etc. shall be confiscated. Strict action will be taken against company owners who do not provide suitable accommodation according to the country's labour laws.
Companies that do not provide accommodation to employees should pay accommodation allowance to them. Other recommendations include providing safety systems and equipment to prevent injury and illness at work, educating workers to avoid risks, ensuring compliance with health and safety standards, and educating workers about labour laws in a language they understand.
