Land expropriation; current market price has to be paid in case of delay in compensation; historic judgment of Supreme Court

NEW DELHI: The Supreme Court has said that the government cannot acquire private land without paying appropriate compensation. If the compensation is delayed, the current market price will have to be paid. The landmark judgment was delivered by a bench comprising Justices BR Gavai and KV Viswanathan.

The court was hearing disputes related to compensation for land acquired for the Bengaluru-Mysore corridor. The judgment was made using the prerogative conferred by Article 142 of the Constitution.

The Supreme Court criticized for not providing adequate compensation even after 22 years of the Bengaluru-Mysore Corridor case. Government of Karnataka, Karnataka Industrial Sector Development Board etc. have a lazy attitude. The land was acquired in 2003. No compensation order was issued then. The landowners then approached the High Court. The order was issued in 2019 after finalizing the price in 2003. Petitions reached the Supreme Court questioning this. The Supreme Court ordered that compensation should be allowed to the owners according to the market price of 2019.

Property rights are human rights

The Supreme Court observed that property rights are human rights in a welfare state and a constitutional right under Article 300-A of the Constitution. Delay in compensation to the owners even after expropriation is against the essence of the Constitution and the concept of a welfare state.
