Apply at village office with title deed; Revenue Department issues order regarding Thandaper and possession certificate for flats

THIRUVANANTHAPURAM: The Revenue Department has ordered to issue separate Thandaper and possession certificate for each flat in multi-storey complexes. This step was reported by Kerala Kaumudi on April 10. The significance of the new order is that the flat owner will get the right to pay tax in his own name. The current flat owners should apply to the concerned village office along with a copy of the title deed.

The order states that in the case of transfer of ownership of flats, mutation should be allowed only if the ownership of the land has also been transferred under the title deed. In cases where the ownership of the land has not been transferred, the current method the land owner paying the tax will continue.

The title deed should be checked to ensure that the land transfer has taken place. The mutation should be done by giving a sub-number of the existing Thandaper of the flat /institution. For example, if a person named A and another person named B buy a flat in an apartment on Thandaper land "100", then A should be given Thandaper of "100/1" and B should be given Thandaper of "100/2". Each sub-thandaper party will be given a separate possession certificate with undivided rights. All the survey numbers of the parent-thandaper should be added to the sub-thandapers accordingly.

Proportional area of ​​land to be reduced

  • When each new thandaper is formed, the proportional area of ​​land should be reduced from the mother thandaper. After the indivisible right equal to the area of ​​the entire land is given, the mother thandaper should be vacated and made inactive.
  • Such land tax payment system should be implemented for the residents of tsunami-affected rehabilitation flats.
  • In cases where undivided right is transferred along with the land right without mentioning the area, it should be recorded Undivided Share (UD) on the tax receipt. Then, at the rate applicable in the local government area, the tax applicable to the land area or the minimum tax per acre, whichever is higher, can be levied by dividing the total land area by the number of flat owners.
