Supreme Court stays high court order declaring Munambam land not Waqf land

NEW DELHI: The Supreme Court has stayed the Kerala High Court’s ruling declaring the land in Munambam not Waqf land and directed to maintain the status quo. Meantime, the Supreme Court ordered that the work of the Munambam Commission can continue and that the investigation commission can proceed with the proceedings. The court issued notices to the opposing parties, including the state government. The case will be considered again after six weeks on January 27. The court's action is on an appeal filed by the Waqf Protection Forum to stay the high court order.


A bench comprising Justices Manoj Mishra and Ujjwal Bhuyan pointed that it has not stayed the observation of the Kerala High Court, which upheld the government’s decision to appoint a panel to examine the status.


The Kerala Waqf Protection Forum had pointed out that the high court could not pass a verdict as the Munambam land dispute was under consideration by the Waqf Tribunal and that the issue before the high court was whether a commission could be appointed in the Munambam land dispute. The Supreme Court took action considering this.
