
KANPUR: Shivam Mishra, son of Uttar Pradesh tobacco businessman K K Mishra, has been arrested in connection with the incident in which three people were injured after being hit by a Lamborgini car. He was arrested in Kanpur on Thursday morning. After the accident, Shivam had reportedly gone into hiding. His family had earlier claimed that he was undergoing treatment in Delhi. However, police received information that he was in his hometown and recorded his arrest at dawn.
There were also attempts to portray that Shivam was not driving the car at the time of the accident and that his driver, Mohan, was behind the wheel. Mohan subsequently filed a petition seeking permission to surrender before the court. However, the Additional Chief Judicial Magistrate rejected the plea. Police informed the court that Mohan was not an accused in the case and that the investigation clearly showed Shivam Mishra was driving the car. Following this, the court dismissed Mohan’s surrender application.
The defence lawyer told the court that an agreement had been signed on February 8 between one of the injured persons, Mohammad Taufiq, and driver Mohan. As per the agreement, the accused side would bear the medical expenses of the injured, and in return, no further legal action would be pursued.
However, the court accepted the prosecution’s argument that a person who is not an accused in the case cannot enter into such an agreement. The court has also directed that a technical inspection report from the Regional Transport Office (RTO) be submitted in connection with the car owner’s request to release the damaged Lamborghini. The court ordered that the documents be produced before the investigating officer. Meanwhile, the lawyer for driver Mohan said that the police have wrongly named Shivam Mishra as the accused and that an appeal will be filed before the district judge’s court.
