POCSO case victim's six-month pregnant baby must be taken out; Government should look after the child, orders High Court

KOCHI:The Kerala High Court allowed a six-month-pregnant 15-year-old's baby to be taken out in a POCSO case. The court order is on a petition to allow abortion on the grounds of health. It is stated that if the girl does not take charge of the baby that is taken out through surgery, then the government should take over the responsibility. Justice VG Arun declared the order.

The High Court also directed that a medical board should be formed immediately and action should be taken to take out the baby. The court also considered that delaying the decision will increase the pain of the girl. It has also been instructed to provide better treatment to the baby if it is taken out alive. The case was adjourned for retrial after ten days. The court intervened out of humanitarian concern, as abortion of the foetus after six months of preganancy is not allowed as per law.
