NEW DELHI: The Supreme Court has rejected the petition filed by the son against his mother in the Kadakkavoor POCSO case. A bench comprising justices Suryakant and JB Pardiwala dismissed the petition. The petition sought the cancellation of the special investigation team's report and the mother's bail.
An investigation team led by Dr Divya Gopinath had submitted a report in June last year stating that the mother was innocent and that the allegation that she had sexually assaulted her son was false. Based on the report, the High Court ordered the case to be quashed and the Thiruvananthapuram POCSO court closed the proceedings in December. However, the son approached the Supreme Court saying that the High Court did not hear his argument. In his petition, he stated that the High Court order should be quashed and the mother should be directed to face trial.
The special investigation team had informed the high court that the report was prepared taking into account the findings of the medical board headed by the superintendent of Thiruvananthapuram Medical College and the results of scientific tests. While the boy was abroad with his father, he was found watching a porn video. The report said that in order to escape from it, the son levelled the allegation of sexual abuse against his mother. The investigation team's report also mentioned that there was no motive behind the boy’s complaint against his mother.
