SC directs premature release of all six convicts including Nalini in Rajiv Gandhi assassination case

NEW DELHI: The Supreme Court on Friday directed the premature release of all the convicts including Nalini who had been serving life sentences in the Rajiv Gandhi assassination case. A bench led by B R Gavai ordered the release of all the six. With this, all the accused in the case will be set free. Nalani has been in jail for 31 years. She was granted parole several times.

Another accused in the case A G Perarivalan was released on May 18, 2022 after being in jail for 30 years. Soon after the release of Perarivalan, Nalini and P Ravichandran filed a release plea in the Madras High Court, but it was rejected. The Madras High Court held that the high court had no power to exercise the prerogative of Article 142. The high court said they can approach the Supreme Court. Following that, Nalini filed a plea in the Supreme Court last August demanding her release.

Rajiv Gandhi was assassinated on the night of May 21, 1991 at Sriperumbudur in Tamil Nadu while attending an election rally. After the trial in a special TADA court, the accused were sentenced to death. The higher court upheld the death sentence on May 11, 1999. However, in 2014, the Supreme Court commuted the death sentences of three including Nalini to life imprisonment. This was because their mercy pleas were delayed by 11 years.
