Jisha murder case: Accused Ameerul Islam cannot be transferred to Assam, says SC

NEW DELHI: The Supreme Court said Ameerul Islam, the accused in the Jisha murder case in Perumbavoor, cannot be transferred to Assam under the present jail rules. The apex court directed to question the 2014 rules issued by the Kerala government if the transfer of the jail is necessary. The Supreme Court postponed to consider the Ameerul's plea to December 5.

Ameerul filed the plea seeking to transfer him from Viyyur Central Jail to Assam Jail. He pointed in the plea that his wife and parents in Assam are in extreme poverty and are facing difficulty in coming to Viyyur to meet him.

Ameerul Islam was shifted to Viyyur Jail after the trial court awarded him death sentence for brutally raping and murdering law student Jisha. He has filed a plea in the high court against the death sentence. The lawyer appearing for Ameerul told the court that this is a basic human rights issue.

However, the condition is that those sentenced to death under Section 587 of the Prisons Act, 2014, cannot be transferred. Even if the appeal against the death sentence is under the consideration of the court, they cannot be transferred to another jail. A bench headed by Justice Dinesh Maheshwari pointed out that the demand for transferring to Assam cannot be accepted while these conditions remain in place.
