Cases pending without settlement

court

The number of cases pending in the courts of the state is rising every year. More than 20 lakh cases are pending in higher and lower courts. It was 16 lakhs in 2019.
Some civil cases from 1968 are still pending in the high court without settlement. As per national judicial data grid, 30 percent of the cases pending in the high court in both civil and criminal categories are five to ten years old.

Justice P V Kunhikrishnan pointed in a verdict that if the cases are not settled in a timely manner, people are likely to lose faith in the judicial system. Thiruvananthapuram has the highest number of pending cases. 3.82 lakh cases. Ernakulam is in the second with 2.99 lakh cases. The number of pending cases in Kollam, Kottayam, Pathanamthitta and Thrissur are more than a lakh.

There is a crore of pending cases in the country. It also includes cases that started before India's independence. 69,781 cases are to be settled in the Supreme Court alone. Out of these, 489 cases are to be considered by the constitution benches. Nearly 60 lakh cases are to be settled in the high courts of the country. The snail-paced court proceedings are the main reason for the delay in settling the cases. As per the present practice, a case can be postponed many times. If this is stopped, the number of cases will drop. Cases can be divided into different categories and can be solved through adalats. Though courts are adopting this approach, there is not much progress as expected. The effort to solve the shortage of judges and courts should be there along with this.

Courts are not the only reason for pending cases. This problem can be solved only if there is more active cooperation from the side of the prosecution, lawyers and the police. If the cases prolong, the lawyers can collect fees from the parties for that much of time. How to use modern technology to settle cases should be learned effectively and implemented. Justice delayed is justice denied. So, both the courts and the government should try to solve this. The government should abandon the regular practice of delaying infinitely the recommendations for the appointment of judges by the collegium. Along with that, the infrastructure in the courts should be increased and maximum modern technology should be used.
