NEW DELHI: The Supreme Court has cancelled the action taken by former UDF government withdrawing the hate speech case registered against Eranad MLA and Muslim League leader P K Basheer. The division bench led by Justice Dipak Mishra directed the magistrate court to continue the case. The division bench also stated that the magistrate bench can take decision in all the matters including the withdrawal of the case.
The case against Basheer was registered when a teacher was killed in the strike conducted by Youth League during the tenure of former LDF government. James Augustine was killed while attending cluster meeting in Kirissery government school when Youth League activists conducted a strike against a controversial chapter in the social science text book of seventh standard. Some Youth League members were arrested in connection with this incident. Basheer made the controversial hate speech in a public meeting.
“Eranad Muslim League committee has taken a decision. As the president of this committee, what I have to say is that if anyone comes to the court to testify as witness, they will not return alive”, said Basheer in a controversial speech.
