THIRUVANANTHAPURAM: Bar bribe case is all set for another investigation after Vigilance informed HC that government’s permission is not needed for investigating the same. There are three important reasons for the new approach from Vigilance, who gave clean chit to Mani three times in the case.
Scene changed when former special prosecutor K.P. Satheesan, who was dismissed for not agreeing to Mani’s demands, became the advocate of Biju Ramesh, the petitioner. Satheeshan sought Governor’s permission to prosecute Mani and also filed a petition against the Vigilance at the HC. But Governor P. Sadashivam didn’t grant permission stating that the case is still under court’s consideration. However the Vigilance was wary whether the Governor might grant permission if more legal pressure was made.
Delhi HC recently stated that in cases of corruption, if criminal charges are alleged prima facie, there is no need for government’s permission to conduct investigation. Adv. Satheesan also listed seven other verdicts of similar nature.
Vigilance wrote a clean chit by ignoring facts based on mobile tower location. Investigation team’s trustworthiness was questioned by Vigilance court by listing out witness statements and reports.
