NEW DELHI: The Supreme Court came forward with an explanation in forming a larger bench in Sabarimala issue. The explanatory note stated that there is nothing wrong in forming a larger bench and such benches have been formed earlier also. The apex court had released a 29-page explanatory note.
The court’s explanation is that there is nothing wrong in larger benches considering cases to examine constitutional issues and to ensure justice. According to Article 142, constitutional questions can be given to the larger bench. The court also recalled that an 11-member bench had earlier considered a case on minority rights.
