ed-raid

THIRUVANANTHAPURAM: As per law experts, the intervention of the Kerala Child Rights Commission in ED's raid at Bineesh Kodiyeri's house was immature which could backfire for Bineesh.

ED conducted the raid with the legal protection of the Indian Money Laundering and Search Act 2005. It is the legal responsibility of the family to cooperate with the raid and outsiders cannot intervene.

The child was with the mother. Only the mother has the right to complain that medicines or her presence were denied and the complaint should be given to ED. The intervention of the Kerala Child Rights Commission is lawfully wrong. If the ED sleuths mention this in their report to Assistant Director, Kerala Child Rights Commission will have to face trial.

According to prominent advocate Ajayakumar, local police cannot register cases against ED officers. The raid can go on for as much time as needed and no one can leave the house. If the family does not sign on form 2 mentioning the credit card of a 'Benami' was found, that could go against the accused. There is no rule that the object needs to be found in the presence of the family members. If the family members won't sign, one or two people from outside the ED team can sign. The accused has to prove the object was not found from his house.
