THIRUVANANTHAPURAM: Recent report claims that the Kerala police might withdraw from its move to register a case against Enforcement Directorate (ED) officials for detaining the wife and daughter of Bineesh Kodiyeri during a raid at his house. City Police Commissioner Balram Kumar Upadhyay said that the case against ED was impossible as they came for the raid with a court warrant under CRPC-100.
Police have not yet received the order of the Child Rights Commission to register a case. According to sources, the action was abandoned by the commission as it was not legal. The Commission has made it clear that the case investigation of the Enforcement Directorate does not fall within its jurisdiction.
Kerala Kaumudi had reported yesterday that the state police did not have the power to register a case against ED and if there was a complaint about the raid, it could only pass on the information to top ED officials.
Under Section 54 of the PMLA Act, all Central and State officials, including the police, are required to assist the ED in its investigation. The official proceedings of the ED cannot be interrupted. In case of any illegal action, the victims of the raid should inform the court which is considering the case.
