KOCHI: The state government is approaching the Supreme Court in the actress attack case. The government is moving the apex court seeking transfer of the trial court. The government is seeking a change of court under CRPC 406.
The state government is approaching the Supreme Court challenging the high court order. The arguments raised in the high court will be mainly informed to the Supreme Court. It would be argued that the high court order was not after examining all legal aspects. The main argument would be that the high court verdict was not in line with the changes made in the 2013 amendment.
The government lawyers have already started legal matters related to the plea to be submitted in the Supreme Court. Discussions are being held with the lawyers in Delhi. It is believed that senior lawyers will appear in the Supreme Court.
The government had earlier thought of approaching the division bench of the high court on the same issue. However, the decision to go to the Supreme Court seeking a change of court under CRPC 406 is now pending as the order of the full bench of the high court had prevented this.
Meantime, the trial court is moving forward with the proceedings following the high court verdict. The apex court had directed that the trial be completed by February 4. Therefore, the trial court is trying to expedite the trial in the case. Suresan, the special prosecutor in the case had resigned. However, the home department has not accepted his resignation.
