NEW DELHI: The Supreme Court rejected state government’s plea seeking transfer of trial court in actress attack case. The court showered harsh criticisms against the government. The apex court observed that the trial court could not be transferred raising the allegation that the judge was highly biased.
If the court takes a decision, the government can legally question it. Instead filing a plea seeking change of the judge is not a proper manner. The demand of transfer of trial court cannot be agreed. The government can approach the high court if they have any objections on the verdict of the trial court, the court clarified.
As the case got a lot of media attention, the judge may have been under pressure. However, the apex court observed that such references on the part of the state government should not be raised against the judge or the court.
The state government told the court that despite secret trial, about 20 lawyers were present in the court and that the trial court judge made derogatory remarks about the victim. However, the apex court did not take these arguments at face value. Meantime, the Supreme Court gave time for the government to appoint a new public prosecutor in the event of the resignation of the public prosecutor.
