NEW DELHI: The Supreme Court has ruled that anticipatory bail will not be granted in rape cases. A bench comprising Chief Justice SA Bobde, Justices AS Bopanna and V Ramasubramaniam made the direction while dismissing the plea of Anip Divakar, a native of Madhya Pradesh, who was accused in a rape case.
The bench orally observed that anticipatory bail was to be used as a last resort to obtain justice and that anticipatory bail could not be granted arbitrarily, especially in cases of rape.
Anip was accused of molesting his female friend. After the woman lodged a complaint, the accused approached the high court for anticipatory bail. He reached the Supreme Court after the High Court denied him bail.
