KOCHI: The single bench of the Kerala High Court on Tuesday clarified that the references in the January 5 High Court judgment on the disqualification of the office bearers of the SNDP Yogam, including general secretary Vellapally Natesan, would not affect the Yogam or its office bearers including the general secretary.

MK Sanu, the petitioner had contended that the office bearers of the SNDP Yogam should be disqualified for the delay in filing the annual returns. In the January 5 judgment, the single bench directed the registration IG to consider the complaint within three months. The judgment contained a remark about the failure in filing the annual returns of the Yogam. The reference was that adequate steps had not been taken to submit the returns for the years 2013-14, 2014-15 and 2015-16. The High Court had said that the directors would lose the right to reappointment for five years if they make such a fall under the Companies Act.


However, general secretary Vellapally Natesan, president Dr MN Soman and vice president Thushar Vellapally filed a review petition by pointing out that the provision in the Companies Act that would disqualify directors from reappointment came into force on April 1, 2014 and that the observation of the High Court was not correct. In this petition, Justice N Nagaresh said that the references in the earlier judgment would not affect the meeting or the office bearers in any way.
