KOCHI: The Kerala High Court on Monday stated that The Dissolution of Muslim Marriages Act did not do away with the practice of extrajudicial divorces available to Muslim women under section 2 of the Shariat Act. The division bench comprising Justice Mohammad Mushtaq and Justice CS Dias issued the historical judgement by quashing the 49-year-old in the KC Moin-Nafisa case.

In a series of petitions, the High Court overturned an old ruling that Muslim women have no right to divorce unless through court or judicial proceedings. The court observed that Muslim women were not even allowed to take legal action when illegal methods such as triple talaq were used by Muslim men to get a divorce.
