NEW DELHI: The Kerala government has approached the Supreme Court against the High Court order quashing the compassionate appointment of the son of late Chengannur MLA KK Ramachandran Nair. The government has filed a petition in the Supreme Court stating that the High Court does not have the power to cancel appointments on a PIL and that the cabinet has the power to create special posts.
The government also demanded that the High Court order canceling the appointment should be stayed immediately. The state government had appointed Prasanth, son of KK Ramachandran Nair, to the post of assistant engineer in the Public Works Department.
The High Court issued the order cancelling the appointment of Prasanth while considering the petition filed by Ashok Kumar, a native of Palakkad. In his petition, Ashok Kumar had contended that the appointment of Prasanth in the gazetted post made on compassionate grounds was illegal as the MLA was not a government servant.
