THIRUVANANTHAPURAM: Lokayukta, the quasi-judicial body, weakens the constitutional conditions, said CPM state secretary Kodiyeri Balakrishnan. Governor is the one who appoints ministers in the state and decides the chief minister based on the front’s majority. The Lokayukta weakens this constitutional matter, mentioned Kodiyeri in an article published in the party’s mouthpiece Deshabhimani.

The government is elected by the people. The current situation enables the centre to misuse the law and intervene into the matters of the state through the governor, in order to weaken or destabilise the state government.

The central government can interfere to weaken the state government through the governor, using its current right to accept or reject Lokayukta’s decision. It is under this circumstance, the LDF government has promulgated the ordinance, said Kodiyeri in the article.

Kodiyeri said’ a constitutional right is there to produce the ordinance to the governor when the assembly is not in session and the opposition can opine when it comes before the assembly as a bill. The government will seriously consider all the opinions and accept those required and reject others, he said in response to the statements by CPI state secretary Kanam Rajendran among others. The current situation in India is not the same as it was in 1996, when the Lokayukta law was enacted by the Nayanar government, reminded Kodiyeri.
