KOCHI: The Kerala High Court will reconsider actor Dileep's anticipatory bail plea in the conspiracy case to harm the investigating officers in the actress attack case, tomorrow. The court had earlier decided to consider it on Thursday but later changed their decision. The plea will be considered tomorrow afternoon at 1.45 pm.
Dileep had handed over six phones to the court Monday morning. Three phones used by the actor, two phones of his brother Anoop and one of his brother-in-law T N Suraj were produced in the court in a sealed cover.
Dileep said that he does not have the first phone mentioned by the police. The actor handed over 2,3,4 phones stated in the list. Dileep said the iPhone mentioned in the first serial number may have been used in the past or seized by the investigation team.
Meantime, the prosecution said Dileep was not cooperating with the investigation. The prosecution contended that the evidence was destroyed by concealing the court order and that the conduct of the accused is such as to prove their guilt. Dileep is getting a benefit that no one else is getting. You are not even entitled to get natural bail, the court said while considering his anticipatory bail plea. The investigation has gone a long way. The prosecution said that granting bail would create a false precedent and that it was not up to the accused to decide where to keep safely the phone.
Dileep who earlier said that he does not know about the fourth phone, told the court today that he doesn’t know about the first phone. The prosecution argued that the accused is repeatedly changing his statement.
Dileep argued that the investigation team don’t have any strong evidence to confirm the conspiracy. What is happening is a media trial. Gave all the gadgets in the house to the officers. Arraigned everyone except his mother. Don’t have faith in crime branch's investigation and will seek a CBI probe.
Meantime, the prosecution wants the phone to be produced immediately. The court said let the investigating officers check the phones and isn’t it appropriate to consider the anticipatory bail plea after that. Following that, the court postponed the case to Thursday. However, Dileep's lawyers argued that the phones should not be handed over to the probe team till Thursday. However, the prosecution said the probe team needed it today itself. At the end of the dispute, the court decided to reconsider the case tomorrow. The court said it is not entering into the merits of the case now.
