THIRUVANANTHAPURAM: Kerala Governor Arif Mohammad Khan, who is on a visit to Lakshadweep, will return to the Raj Bhavan visit on Tuesday. The governor had sought an explanation from the government last Saturday on the objections raised by the opposition on the Lokayukta Amendment Ordinance. The government is expected to give an explanation today on the Governor's return. The Governor will take further action on the ordinance after considering this explanation.

Notice for violation of rights against P Rajeev and Kodiyeri
The Opposition has submitted a notice for violation of rights to the Kerala Assembly speaker against Minister P Rajeev and Kodiyeri Balakrishnan for their statements that the Lokayukta Act was unconstitutional. Congress MLA Mathew Kuzhalnadan pointed out in the notice that both Rajeev and Kodiyeri have insulted the Assembly by terming a law passed by the Assembly as unconstitutional.

"No court has so far observed that the Lokayukta act passed by the Kerala Assembly on February 22, 1999, was unconstitutional. While considering the Union Of India vs Elphinstone Spinning & Weaving case in 2001, the Supreme Court had stated that the law passed by the legislature cannot be termed as unconstitutional till the court finds it so. This was a law that was passed unanimously by the Assembly and approved by the President.

No examinations conducted as part of it had found that any of the provisions were unconstitutional. Those who are alleging that a law passed by the Assembly is unconstitutional and those who are attempting to introduce an ordinance without taking the Assembly into confidence are insulting the Assembly," the notice stated.
