NEW DELHI: The Supreme Court has rejected the PSC's claim that everyone on the rank lists with validity extended was not eligible for appointment.
The validity of various rank lists that were about to get expired on June 30, 2016, had been extended to six months. As per the recommendation of the government, the validity of rank lists that were about to get expired between 31st December 2016 and 29th June 2017 was also extended for another six months. However, the PSC decided that those on the first list whose first term was extended would not get the benefit of the second extension. In a petition filed by the candidates against this, the High Court ruled that the decision to extend the second list would apply to all those in the rank lists that have not completed four and a half years. A bench of Justices S Abdul Naseer and Krishna Murari dismissed the petition filed against this by PSC in the Supreme Court. With this, several candidates on the rank lists in 2017 that were not extended for second term are likely to get appointed.
The Supreme Court did not accept the PSC's argument that extending the validity of the rank list was at their discretion and could not be interfered with by the courts or tribunals.
