KOCHI: The Kerala High Court on Tuesday said that persons belonging to the reserved category will not lose the reservation benefit if they marry persons belonging to other communities. The single bench explained that this was confirmed by the Supreme Court.

Justice PV Kunhikrishnan made this clear in a petition filed by Beksi, a member of the Latin Catholic Church and a native of Idukki, against the denial of reservation benefit in the name of marriage. The petitioner got married to a man belonging to Roman Catholic Church in 2005. After this, she was appointed as LP School Teacher through PSC. When she applied for the caste certificate at the Irattayar village office, the village officer informed her that they could not issue the certificate of being a member of the Latin Catholic community as she was married to a member of the Syro-Malabar Church. Following this, she approached the High Court against this. The High Court had in an interim order directed to issue caste certificate and non-creamy layer certificate to the petitioner.
