NEW DELHI: The Supreme Court has said that a candidate from the reserved category who gets higher marks than the last rank holder in the general category should be considered for appointment in the general category. A bench comprising Justice MR Shah and Justice BV Nagaratna was hearing an appeal filed by BSNL against the Rajasthan High Court's order to appoint two candidates from the reserved category in the general category as they got higher marks. The High Court had issued the verdict after finding that two persons named Alok Kumar Yadav and Alka Saini scored higher marks than those in the general category.

The Supreme Court upheld the High Court judgment and dismissed BSNL's appeal. The apex court directed to ensure that this judgment does not impede the recruitment process in BSNL and that the two candidates appointed in the general category should not be removed.
