KOCHI: Swapna Suresh, accused in the gold smuggling case, is moving the court seeking a copy of the secret statement given to the customs in the dollar smuggling case. Swapna is approaching the court after customs opposed to hand over the secret statement to the Enforcement Directorate (ED).

Swapna's move alleges mystery on customs stand opposing to hand over the confidential statement to another investigative agency. The court cannot deny if the person who gave the secret statement requests a copy of it. Swapna is demanding a copy of the secret statement following allegations of political interference over dragging of the customs investigation into the case.

The special economic offences court in Kochi had rejected Enforcement Directorate’s plea seeking the secret statement. The court ordered that ED could not be given the secret statement of Swapna as the investigation in the dollar smuggling case has not been completed. Customs, the investigating agency had also opposed it.

The customs brought to the notice of the court Supreme Court’s order in handing over the secret statement. The customs argued that the Supreme Court order stated that confidential statements should not be given to another investigative agency in cases where the investigation has not been completed. The order of the special court was in view of this.

The CPM leaders had publicly responded that there were contradictions in the secret statements of Swapa. These matters will also be brought to the notice of the court. After discussions with the lawyers, Swapna is planning to file a plea in the court the next day.
