THIRUVANANTHAPURAM: The CPM has stated that the remark made against the survivor in the court order granting anticipatory bail to Civic Chandran is a matter of concern. This was said in a statement by the state secretariat.


"Courts have the right to judge the issues before them and pass orders. But the court's remark on the complainant's dressing, in this case, was against the Supreme Court guidelines", CPM's statement reads.

This is totally contrary to the Supreme Court directive that court proceedings in such cases should not cause mental hardship to the people. Such a reference comes when the Supreme Court has made it clear that even when the counsel for the accused is cross-examining the complainant, there should be no derogatory questions or remarks.


In the statement, the secretariat stated that the court's reference regarding the dressing is also an encroachment on the personal freedom guaranteed to the citizen under Article 21 of the Constitution.
