KOCHI: The Kerala High Court has said that the courts cannot restrain a Muslim man from pronouncing talaq as it is an act in accordance with the Muslim law. The court also observed that courts cannot restrain a Muslim man from marrying more than one person. A division bench comprising Justice A Muhammad Mushtaq and Justice Sophie Thomas said that if a court passes an order restraining a Muslim man from acting in accordance with his personal belief and practice, then it would be a violation of religious rights guaranteed under Article 25 of the Constitution.
The division bench made the observation on a petition filed by a Muslim youth from Kottarakkara against the family court allowing the petitions filed by his wife seeking to prevent the husband from pronouncing talaq and remarrying.
