KOCHI: Many of the allegations levelled by the Governor against the Chief Minister yesterday will pave the way for legal battles against the government in the coming days. According to former Director General of Prosecution T Asaf Ali, Governor's allegation that the government did not take any serious action against those who protested at the History Congress in Kannur is a serious one.
Under IPC 124, preventing the President and Governors from exercising their powers is punishable with imprisonment of up to seven years and a fine. It is just that no case has been registered under this section in independent India so far.
The governor had earlier said that a move was made to assassinate him at the History Congress and that a conspiracy regarding this had taken place in Delhi. On the allegation, the police can voluntarily file a case under Section 154 of the Code of Criminal Procedure. Although a lawyer in Kannur lodged a complaint with the SP, no action was taken. In this case, a complaint will be filed in the Magistrate's Court on the next day.
The governor can ask for a CBI probe into the allegations of conspiracy in Delhi. A third person can approach the police and the Magistrate Court by pointing this out.
