THIRUVANANTHAPURAM: Governor Arif Mohammed Khan on Monday issued a stern warning to Kerala ministers over their remarks against him and his office. Taking it to Twitter, the Governor warned that he will take strict action against the ministers if they lowered the dignity of the governor’s post. If this happens, will not hesitate to withdraw the ministers, he tweeted.
"The CM and Council of Ministers have every right to advise Governor. But statements of individual ministers that lower the dignity of the office of the Governor,can invite action including withdrawal of pleasure," said the Governor in his tweet.
The governor got provoked after Higher Education Minister R Bindhu slammed him for not signing a Bill which would have given a "revamp to the education sector".
"Those holding Constitution posts should act accordingly. We all saw how he went to the RSS headquarters and this does not augur well," Bindhu said on October 12.
Following the governor's warning, the minister clarified that she had not belittled the governor.
The Governor issued the warning by pointing out the powers of the Governor mentioned in Articles 163 and 164 of the Constitution.
According to provisions of Article 164 of the Indian Constitution, the ministers can continue in their posts for such extended periods allowed by the Governor. According to provisions of Article 163, there should be a cabinet headed by the Chief Minister to assist and advise the Governor in the discharge of his duties. The discretionary decision of the Governor on constitutional matters shall be final. The validity of the Governor's actions cannot be called into question on the ground that discretion has been exercised or not. No advice given by the Ministers to the Governor shall be triable in court.
