NEW DELHI: The state government has filed an affidavit in the Supreme Court demanding to pay the fine of Rs 30.45 lakh imposed by the trial court, to release of Manichan, the accused in the Kalluvathukkal hooch tragedy case.
If accepted by the Supreme Court, which is hearing the case on Wednesday, then he will have to serve an additional 22 years and nine months in prison. Release is possible if the court waives the fine.
According to the affidavit filed by Standing Consul Harshad V Hameed on behalf of the state government, the High Court’s verdict was to pay the fine amount to the families of the victims who died in the disaster and those who have lost their sight. The Supreme Court is considering the petition filed by Manichan’s wife Usha demanding his release.
Manichan and the other accused were sentenced to life imprisonment and fine. Attingal First Class Judicial Magistrate's Court and the Kollam Additional Sessions Court had made it clear that if the fine is not paid, he would have to serve an additional 22 years and nine months in jail.
Two other accused, Vinod Kumar and Manikandan, were released without paying fine. Both had to pay a fine of Rs 8,30,000. It was also ordered that if they do not pay the fine, they will be sentenced to eight years and four months in prison.
Manichan’s financial condition is pathetic now. All properties were confiscated including his wife’s. Manichan’s building in Pulimoodu is also under possession of government.
