KOCHI: The High Court bench, considering the sexual harassment case against Eldhose Kunnappillil MLA, directed the probe team to examine whether the sexual relationship between the complainant and Kunnappillil was consensual. The High Court gave the direction while considering the petition seeking cancellation of the MLA's bail in the case. The High Court pointed out that false allegations are as cruel as rape. The court also said that the complainant had not raised sexual harassment charges against the accused in her first complaint. The prosecution also admitted this.
The court said that when examining the first statement, it is understood that the sexual relationship was consensual. "The complaint and arguments seem like a movie story. Thiruvananthapuram Magistrate Court granted anticipatory bail to the accused with due reasons. There must be clear reasons for canceling it," the court said. The court also asked how the case of attempted murder would stand.
