NEW DELHI: The Supreme Court has directed that those occupying high positions, public functionaries and government servants to avoid offensive statements. The observation is by the Constitution Bench, which considered the petitions against ex-minister MM Mani's controversial speech insulting ‘Pembilai Orumai’ protest in Munnar. The petitions demand that public servants including ministers should have guidelines that prevent remarks that hurt the sentiments of others.

The bench pointed out that such a practice is followed by judges. The Constitution Bench observed that bringing guidelines to elected representatives including ministers, is not an interference in the functioning of the legislatures. The petitions were adjourned for judgment.

Appearing for the Central Government, Attorney General R Venkataramani and Solicitor General Tushar Mehta argued that such guidelines are not necessary. The AG and SG also pointed out that two judgments of the Supreme Court had issued guidelines regarding the action to be taken against hate speech. But the petitioners pointed out that these guidelines do not apply to those in high positions. The constitution bench is headed by Justice Abdul Nazir. Justice BR Gavai, Justice AS Bopanna, Justice V Ramasubramaniam, Justice BV Nagarathna are the other members.
