Though it is said that marriages are made in heaven, the reality is that couples are living on earth and thus they have many problems. It is usual to have small quarrels and issues in any married life. In modern times it is seen that divorces are on the rise.
One of the foundations of a strong married life is the mind to accept each other. In modern times the patriarchy will not be tolerated much. People marry and get divorce after long retrospection. If it is mentally impossible to live together, then it is better to get a divorce. If the divorce is not mutually agreed it would be a difficult process. The case will lag in court. A huge money should be doled out to the lawyer also.
It is important that divorce process is made more simple. The High Court has pointed to the need of a uniform law for marriage while delivering an important verdict related to Christian divorce case. The government must take notice of this.
The court struck off a backward clause in the 1869 divorce law for Christians. The clause said that for Christian couples who want a divorce, they must wait for one year before they can submit a divorce papers. The court annulled that clause.
The court cancelled that clause on the grounds that it was against fundamental rights and against the constitutional values. The petitioners were a couple who married last January 30. They mutually decided to file for a divorce and applied for it on May 31 at Ernakulam Family Court. However, the court rejected their application citing that they can apply only after one year. Following this they approached the High Court.
The High Court ordered that divorce must be allowed within two weeks. In a secular country the laws must be for the common good therefore a uniform law is necessary, observed the court. This must be taken seriously by the central government. In addition, discussions must be made to make the divorce process more simple and easy.
If two persons find it difficult to live together, it is best to leave them on their own paths. That would be much better for the future of the two parties. Making delay in it in the name of law will not do anybody any good.
