THIRUVANANTHAPURAM: The government will dismiss the criminals in the state police force as soon as it gets permission from the PSC. It has handed over the file to PSC in this regard.
The rule states that the appointing authority can pass orders of dismissal only with the approval of PSC, the recruiting authority. The Disciplinary Sub-Committee of the PSC will study the file and record the proposal. The PSC chairman will approve it and forward it to the government. It is indicated that PSC will complete the process quickly.
The DGP has recommended dismissing 59 policemen, including Kozhikode Coastal Police CI PR Sunu, who was accused in six cases, including rape, and faced departmental investigation and action 15 times. The Law Department has approved this recommendation.
Law Secretary V Hari Nair had advised the Home Department to close all the loopholes and issue an order so that these criminals do not approach the court and return to the police force. They will be dismissed in accordance with the orders of the Supreme Court, the provisions of the Constitution and the provisions of the Kerala Police Act. The government decided to "cleanse" the state police after Kerala Kaumudi published a series about criminals in the Kerala police.
The Law Department has directed that the steps under Article 311 of the Constitution should be completed in order to fire the police officers. According to this, those below the appointing authority cannot issue an order of dismissal. After the departmental enquiry, the police officers should be presented with the charges and evidence against them and given an opportunity to explain their side. Those up to the rank of SI can be dismissed by the State Police Chief and the District Police Chiefs. The Home Department will issue an order dismissing those above that. Policemen who are accused in cases punishable by less than seven years will not be dismissed at this stage.
