KOCHI: A plea has been filed in the High Court seeking withdrawal of the police action that acquitted former Minister Saji Cheriyan in his anti-Constitution speech. The plea filed by Advocate Biju Noel demanded that the investigation in the case should be handed over to the CBI or the Karnataka Police.

The petitioner alleged that despite having many witnesses against the MLA for speaking in contempt of the Constitution, the police presented a report protecting Saji Cheriyan without properly recording statements of the witnesses and conducting an investigation.

The division bench headed by Chief Justice S Manikumar had dismissed the petition against Saji Cheriyan with the observation that there is no legal provision to remove him from the post of MLA. The police had also submitted a report saying that it was stopping the investigation against the former minister over his anti-Constitution remark.
