NEW DELHI: Supreme Court on Thursday said that death due to sunstroke will not come under the scope of accident insurance. The bench headed by Justice SK Kaul said this while issuing the verdict on the incident in which a constable died due to sunstroke during election work in Bihar. In 2000, the National Insurance Company and the Chief Electoral Officer of Bihar had signed an MoU to provide insurance coverage to individuals assigned to election activities during the 2000 assembly elections. After the death of a constable due to sunstroke during election work, his wife approached the Patna High Court demanding an insurance amount of 10 lakhs. Although the High Court issued a favourable verdict to the constable's wife, the company filed an appeal in the apex court pointing out that death due to sunstroke will not come under the scope of accident insurance. The Supreme Court issued the verdict upholding this argument.
