MARADU: 3 months to attach properties
NEW DELHI: The Supreme Court has ordered the demolition of Kapiko Resort, which was built in violation of the Coastal Management Act on Nediyathuruthu Island, Panavally, Alappuzha, by March 28. The court criticized the state government for not taking action even after three years of ordering the demolition. A bench headed by Justice Sudhanshu Dhulia warned that the Chief Secretary will face contempt of court if the building is not demolished by March 28.State government's lawyer CK Shashi informed the court that the demolition process has been initiated. He also asked to allow some more time. Then, time was given till March 28 as a last chance. The Supreme Court ordered the demolition of Kapiko Resort in January 2020.
Meanwhile, a bench headed by Justice BR Gavai allowed the government's request for three months more time to attach the properties of the proprietors of Holy Faith Construction Company in connection with compensation to the owners of the demolished flats in Maradu. The Supreme Court had earlier given instructions in this regard. It was also decided to hear a detailed hearing about who is responsible for the illegal construction of flats in Maradu. The Supreme Court appointed Retd. Justice Thottathil B Radhakrishnan Commission had found that the State Government, Maradu Grama Panchayat, and Municipality are also responsible. But the state government said that there is an objection to the findings of the retired High Court Chief Justice. Then the court clarified that the detailed argument can be heard on March 28.
