NEW DELHI: The Supreme Court, on Thursday, quashed the plea seeking to direct the Kerala High Court to consider the petitions against the controversial movie 'The Kerala Story'. The plea of senior advocate Huzefa Ahmadi was dismissed by the bench presided over by the Chief Justice.
Chief Justice DY Chandrachud said that we should think about the hard work of the actors and crew who acted in 'The Kerala Story'. He also opined that let the audience decide whether the film is good or not. Yesterday, the bench chaired by the Chief Justice had directed that petitions against the film should be considered urgently. Based on this, a petition was filed in the Kerala High Court, but the petitioner again approached the Supreme Court stating that the vacation judge was not ready to consider it today.
Advocate Huzefa Ahmadi told the Supreme Court that Acting Chief Justice SV Bhatti of the High Court is on vacation and although he suggested listing the petition before vacation Judge N Nagaresh, the said judge took the stand that the petition would be heard tomorrow. If the Acting Chief Justice is on leave, the Chief Justice has directed to raise it before the second Justice Alexander Thomas. However, the petitioner's lawyer requested that the Supreme Court itself should give instructions in this regard which has now been quashed.
The central government's lawyer pointed out in the Supreme Court that the High Court had passed an interim order on the petition against 'The Kerala Story'. The Supreme Court said that it is for this reason that the High Court did not consider the petition urgently today. The Supreme Court directed the petitioner to raise the matter before the High Court at 10:00 tomorrow morning. But Huzefa Ahmadi pointed out that they are questioning the film's release and Censor Board certificate. He also told the court that if the film is released tomorrow, the plea will become irrelevant.
