NEW DELHI: Kashmiri separatist leader Yasin Malik, who is serving a life sentence in Tihar Jail in the terror funding case, has appeared in the Supreme Court to plead his case, causing a security breach.
The Supreme Court and the Central Government were taken aback by the extreme carelessness of the jail officials in bringing Yaseen Malik, who is in the high security category, who should not be released from the jail, to the court.
A special court in Jammu has directed Yasin Malik to be produced in person for trial in the case for allegedly abducting daughter of former Jammu and Kashmir Chief Minister Mufti Muhammad Syed and the murder of four Air Force personnel. Malik's appeal filed against this in the Supreme Court was directly produced yesterday. A bench consisting of Justices Suryakant and Dipankar Dutta expressed deep displeasure over this. He asked why he was brought without an order to produce. Justice Dipankar Dutta recused himself from hearing the case. The Supreme Court also suggested that Yasin Malik should be produced through video conference in future.
Additional Solicitor General SV Raju explained that it was a mistake made by the jail authorities by misinterpreting the court order.
Solicitor General that there was a security breach
Solicitor General Tushar Mehta told the court that Yasin Malik's appearance in person was a huge security breach. He is a high risk category prisoner. He also assured the court that such incidents will not recur in future. Later, he wrote a letter to Union Home Secretary Ajay Bhalla in harsh language. The letter also informed that there was a possibility that Yasin Malik might escape or be killed while being brought to court.
Investigation
Tihar Jail Director Sanjay ordered an inquiry into the incident. The report should be submitted within three days.
