NEW DELHI: The Supreme Court was taken aback seeing a life-convicted Kashmiri secessionist Yasin Malik inside the court complex when his presence was not required. The court found serious security lapse from the police officials in the Tihar jail complex. Yasin is lodged in the maximum security prison complex and is rarely brought out, if so with an entourage of large police officers.

Yasin Malik’s track record of appalling crimes ranges from kidnapping former CM Mufti Mohammad Sayeed's daughter to killing four airforce officials in the valley. Recently, Malik was asked to appear for a hearing in a special court in J and K. Yasin Malik thus moved a plea in SC to overturn the decision of his required appearance in J and K special court. The SC was considering the case when the Tihar jail officers brought Yasin into the court which put the court in a frenzy.

Justice D Datta on seeing the extremist walk in, recused himself from considering the case. Yasin Malik is arrested for several terror funding cases and is forbidden from any outdoor traveling from the jail complex.

Solicitor General Tushar Mehta wrote a scathing letter to union home secretary Ajay Bhalla stating the lapse from Tihar jail officials. “ Yasin, with a background in terror funding and in camaraderie with neighboring Pakistan could have been forcibly taken away today or could have been killed.” Tushar Mehta wrote. Under section 268 of the criminal procedure code, the jail authorities had no power to bring Yasin to the Court.

The Tihar jail director Sanjay has ordered an investigation into the case. A report will be submitted within three days.
