KOCHI: High Court said that cases should not be filed against those who take injured people to the hospital. High Court said that people would think twice to help if accused in this way and the injured would bleed to death on the road.

Justice Sophie Thomas issued the warning on a petition filed by the mother and wife against Kottayam MACT's denial of compensation for the death of Alexander Kurian, a native of Kottayam Athirampuzha, in a bike accident.

The accident happened on March 5, 2010, near Kaduthuruthy. The relatives of Alexander said in the tribunal that the accident occurred when Alexander's bike hit an oncoming auto and demanded that the insurance company should pay Rs 15 lakh as compensation. Babu Joseph, the auto driver, stated that the accident did not happen due to the collision with his auto and that it was he who brought the injured Alexander to the hospital, and that the police unfairly accused him. MACT denied the compensation after considering other facts in the case and the High Court was approached against this.

Although the auto driver was accused by the police, after further investigation, he was found not guilty. Scientific examination revealed that the bike did not hit the auto and Alexander's bike went out of control instead. High Court dismissed the petition holding that there was no error in denying compensation by the Tribunal in these circumstances. It was then that the high court said that prudent people would hesitate to help in such situations.
