KOZHIKODE: Legal advice has been given to police to proceed with an action in case of scissors stuck in the stomach of woman during delivery surgery. The legal advice is that the case under the medical negligence act can be continued. Legal advice has been received that the police can proceed with arresting the doctors and nurses who have been accused in the case and file a charge sheet. Imprisonment of up to two years may be imposed.
In 2017, Harshina, a resident of Pantheerankaavu, lived with pain for five years after she left the scissors inside her abdomen during the delivery operation. The incident took place during the third caesarean of the woman. After the surgery, she was in severe pain. The doctors said it was because of the pain from the stitches. Then in September 2022, during an examination at a private hospital, it was found that there was a metal object in the abdomen.
Only two doctors and two nurses of the Kozhikode Medical College, who performed the third surgery on K K Harshina, have been accused in the case. The hospital superintendent and others who are currently accused will be exempted from the case. The Kozhikode City Police had also decided not to file an appeal against the District Medical Board's decision. Harshina also protested in front of the secretariat seeking justice.
Meanwhile, KGMCTA, an association of medical college teachers, has come forward against the move of the police. The organization asks what evidence the police have that the incident took place in Kozhikode Medical College. The police are eager to establish that the incident took place in the medical college. The KGMCT is also told that no criminal case can be taken without the permission of the medical board.
