NEW DELHI: The Supreme Court on Monday rejected a married woman’s petition to terminate her 26-week pregnancy. The petition was filed by a 27-year-old Delhi native who is also a mother of two children.
Based on the AIIMS Medical Board report, the court found that the health condition of the mother and baby is satisfactory. The petitioner mentioned in the request about her ailment from postpartum psychosis. However, the AIIMS report denied all this and termed her healthy.
A bench chaired by Chief Justice D Y Chandrachud pointed out that abortion after 26 weeks and five days is a violation of medical regulations.
The CJI while considering the case said that “ The termination would violate Sections 3 & 5 of the MTP Act, and moreover, there is no threat of foetal abnormality”.
The woman earlier approached the Supreme Court with a petition to abort, and a special bench first allowed her to do so. In a retort, the government submitted the AIIMS report and requested the court to withdraw the order.
The central government has informed that there is no unusual situation to remove the pregnancy in this case. The government also assured that the woman would remain healthy even if she gave birth.
The couple informed the court that they could not take care of one more child as the pregnant woman was facing health problems including depression and financial difficulties. The petition came up for the consideration of the Chief Justice in the context of dissenting judgments by the bench of Justices including Hima Kohli and Nagaratna.
The court asked that the parents consider a decision about putting the baby for adoption after giving birth.
